Lawyer Key Comments on Chandrababu and his Lawyer Luthra

A fiery legal battle unfolded in the ACB Court in Vijayawada on Sunday, revolving around the arrest of former Andhra Pradesh Chief Minister N. Chandrababu Naidu in the Skill Development Corporation scam case. The intense arguments commenced at the early hour of 6 a.m. and persisted for more than six hours. The prosecution insisted on a 15-day judicial custody for Naidu, while the legal team representing the TDP leader fiercely opposed this request. Senior Supreme Court lawyer Sidharth Luthra, representing Chandrababu Naidu, contended that the CID had not obtained permission from the Governor before apprehending the opposition leader. Furthermore, Luthra argued that Section 409 would not be applicable to Chandrababu Naidu, and according to the Prevention of Corruption Act, the CID should issue a notice seven days prior to arrest. However, these arguments by Sidharth Luthra faced opposition from another prominent lawyer, who asserted that these legal provisions did not apply in cases of corruption. He has also referred the temporary residence of the former Chief Minister in Vijayawada in the context of the case and arrest. He has cited an example of CM Jagan and other CMs, who were arrested earlier based on the findings. According to this lawyer, the authorities have the right to arrest the accused at any time, regardless of their status as a former Chief Minister or high-ranking official. Additionally, he dismissed Luthra's comments regarding CID call data.
