Lawyer Sidharth Luthra And CID Arguments In ACB Court- Special Report on Chandrababu's Arrest
Former Andhra Pradesh Chief Minister N. Chandrababu Naidu faced extended deliberations in the ACB Court in Vijayawada concerning his arrest in connection to the Skill Development Corporation scam case. The proceedings, which commenced at 6 a.m., persisted for over six hours.
While the prosecution pushed for a 15-day judicial custody of Chandrababu Naidu, his lawyers vehemently resisted this request. Almost a day after detaining him, the Crime Investigation Department (CID) presented Chandrababu Naidu before the court.
Chandrababu Naidu did not shy away from expressing his views, vociferously labelling his arrest as unlawful and a direct product of the political maneuverings of the YSR Congress Party government. According to Chandrababu Naidu, the very essence of the rule of law has been tarnished in the state, as the government is infringing upon the fundamental rights of its citizens. He further clarified that the funds earmarked for skill development initiatives were sanctioned in the 2015-16 state budget, positing that a budget approved by the Assembly cannot be maligned as unlawful.
Additional Advocate General P. Sudhakar Reddy, representing the CID, presented to the court that there is preliminary evidence indicating Chandrababu Naidu's involvement.
Representing Chandrababu Naidu, esteemed Supreme Court lawyer Sidharth Luthra stressed that the CID failed to seek the mandatory permission from the Governor prior to the arrest of the opposition leader. Luthra went on to elaborate that Chandrababu Naidu's implication in the case seemed motivated by political rivalry. He emphasized the charges against Chandrababu Naidu, including those under the Indian Penal Code and the Prevention of Corruption Act, were groundless.
Questioning the CID's actions, Luthra argued that the remand report should be discarded, seeing it as a breach of section 17-A of the Prevention of Corruption Act and lacking credible allegations.
CID's remand report labeled Chandrababu Naidu as the principal architect and conspirator, even though he was initially listed as the 37th accused in the FIR. The CID framed the situation as a calculated conspiracy with the intention of criminal breach of trust and the malicious misuse of public funds. As per the investigation, 141 witnesses were consulted, and their testimonies were chronicled. Based on these documents and testimonies, the CID asserted that Chandrababu Naidu masterminded the conspiracy, collaborating with other accomplices to divert funds from the public treasury meant for the project.
Standing before the judge, Chandrababu Naidu entreated that his statement be officially documented in the court. He reiterated his innocence, refuting any involvement in the Skill Development scam, and branded his arrest as politically motivated.
