Supreme Court Makes Key Observations on Pahalgam Terror Attack PIL

The Supreme Court of India has dismissed a Public Interest Litigation (PIL) seeking a judicial inquiry into the recent terrorist attack near Pahalgam in Jammu and Kashmir. While rejecting the plea, the apex court made several critical observations regarding the sensitivity of the matter.

During the hearing, the bench expressed displeasure with the petitioner and emphasized the need for responsible conduct when filing petitions concerning such delicate national security issues. “The nation is going through a difficult time. All citizens must unite against terrorism. Before filing such petitions, one must understand their sensitivity. Are you trying to demoralize our security forces through your actions? Remember that you also have a responsibility towards the country,” the bench cautioned.

The Supreme Court made it clear that matters involving terrorist attacks should not be brought under judicial review, stating, “Judges are not experts in probing terrorist incidents. Investigative agencies are entrusted with such responsibilities and they are doing their job.”

The petitioner attempted to explain that the PIL was filed with the intention of ensuring the safety of Kashmiri students residing in other states. In response, the court advised that issues related to student safety could be addressed by approaching the relevant High Courts.

Following the Supreme Court's suggestions, the petitioner withdrew the plea.
