HC issued notices to defected MLAs

Today AP High Court (Judicature at Hyderabad for the States of Telangana and Andhra Pradesh) issued notices to all YCP 20 MLAs who defected into ruling TDP. YSR Congress party MLA Vishweshwar Reddy filed a petition appealing to disqualify all the 20 MLAs who defected into TDP after winning on YCP ticket. Petitioner stated that Speaker who is supposed to be neutral was not taking any decision intentionally on the complaints made by YCP. Advocate General argued that as the issue is pending at Supreme Court, the petition cannot be admitted. HC not convinced with this argument and ordered to issue notices to all 20 defected MLAs with four weeks time to provide an explanation. Recently, on the petition of T. Congress over MLAs defection(disqualification), a two-judge bench of SC referred it to a five-judge Constitution bench after assessing the involvement of constitutional questions. As numerous cases pending across the country over defection, it seems Judiciary will use tools like 'Activism' and 'Basic Structure Doctrine' to bring a logical conclusion.
