The Supreme Court on Thursday pronounced its judgment on the constitutional validity of a penal provision of adultery and ruled that “Adultery can be treated as civil wrong for dissolution of marriage, but not a criminal offence”. While pronouncing its judgment, the Apex Court said “Equality is the governing principle of a system. Husband is not the master of the wife”. The Supreme Court stated, “any discrimination shall invite the wrath of Constitution”. The 158-year-old law criminalised adultery and punished a man for having a sexual relationship with a married woman without the consent of her husband.
