SC strikes down PIL for ban on Whatsapp & real time mass messengers

The Supreme Court on Wednesday struck down a public interest petition to ban Whatsapp and and other real time mass messengers on the ground that encrypted messages sent through them could pose a danger to public safety.

The court told the petitioner that he had better consult the agencies and officials concerned with the public safety.

Alternatively, the petitioner had appealed to the court to make the messages passing through Whatsapp and so on to be made accessible to the intelligence agencies.

Counsel for the petitioner argued before the court for the necessity of controls on real time mass messaging. He pointed out that the transmission of the messages was such that no third party could know the message except for the sender and the receiver. This posed a danger to public safety.
